VortexHaus Affiliate Army Program Terms and Conditions

This Agreement describes the terms and conditions ("Terms") governing your participation in VortexHaus's ("Company", "we", "us", "our") Affiliate Army Program ("Program").

You may only participate if you are eighteen (18) years of age or older. By applying, you expressly agree to these Terms.

FAILURE TO COMPLY WITH THESE TERMS WILL RESULT IN IMMEDIATE TERMINATION OF YOUR AFFILIATE ACCOUNT, FORFEITURE OF ALL UNPAID COMMISSIONS, AND MAY RESULT IN LEGAL ACTION.

A. Acceptance and Eligibility

VortexHaus reserves sole and exclusive discretion over the approval, acceptance, and rejection of all applications. Applying does not guarantee acceptance into the Program.

You must be 18 years of age or older. By applying, you represent and warrant that you meet this requirement.

You are only permitted to apply for and use ONE affiliate link and ONE promo code. Applying for multiple links or codes is grounds for immediate termination and forfeiture of all unpaid commissions.

B. Commission and Payment

Upon acceptance into the Program, VortexHaus will provide you with a unique affiliate link and promo code. You will earn a commission on Gross Revenue generated through your affiliate link or promo code on vortexhaus.com, at the rate specified in your individual Program agreement.

"Gross Revenue" refers to the amount actually paid by the customer, excluding shipping, sales tax, and any other charges.

All earned commissions are subject to a 30-day hold period from the date of the original sale. This hold exists to account for potential returns and refunds. Commissions will be released and paid out only after the 30-day hold period has passed. Orders that are returned, refunded, or charged back at any point will not be eligible for commission payout, and any commissions previously paid on such orders may be deducted from future payouts.

Commission rates, cookie duration, and payment terms are specified in your individual Program agreement and may vary. VortexHaus reserves the right to modify commission rates and payment terms at any time. Reasonable advance notice will be provided before any changes are implemented.

C. Referral Bonus

If you refer a creator to the Program who earns $1,000 or more in their own commissions, you will receive a one-time $500 bonus. The referred creator must be a new participant not previously associated with the Program. The bonus will be paid in accordance with VortexHaus's then-applicable payment schedule.

D. Content Requirements

To remain active in the Program, you must create honest, authentic content based on your genuine personal experience with the product. Content may be posted on your existing social media accounts or new accounts created for this purpose.

You agree that your content will:

  • Accurately represent VortexHaus as a premium, professional-grade product
  • Be based on real, hands-on use of the product
  • Not make false, exaggerated, or misleading claims about the product's performance
  • Clearly disclose your affiliate relationship with VortexHaus in all content, in accordance with FTC guidelines (e.g. #partnership, #sponsored, or #affiliate).

You agree that your content will NOT:

  • Position VortexHaus as a product of DeWalt, Makita, Milwaukee, or any other tool brand. VortexHaus is compatible with their batteries but is an independent brand
  • Associate VortexHaus with budget, low-cost, or generic blower products
  • Include inappropriate language, hate speech, or controversial topics
  • Misrepresent the product's features, specifications, or intended use
  • Portray VortexHaus or its products in a negative, unfavorable, or damaging light in any way

VortexHaus reserves the right to determine, in its sole discretion, whether content meets Program standards. Content that violates these guidelines may result in termination from the Program and forfeiture of all unpaid commissions.

E. Partnership Ads

VortexHaus reserves the right to boost, amplify, or use your content as paid partnership advertisements on any platform. By participating in the Program, you grant VortexHaus a non-exclusive, royalty-free license to use, reproduce, and distribute your Program-related content for promotional purposes. You will be credited as a partner where applicable.

F. Brand Guidelines and Prohibited Conduct

You agree to represent VortexHaus in a manner consistent with our brand positioning as a premium, professional-grade product. The following are strictly prohibited:

  • DO NOT position VortexHaus as a budget, low-cost, or Amazon-style product
  • DO NOT reuse VortexHaus's or another affiliate's original content as your own
  • DO NOT share your affiliate link on coupon sites, deal sites, Reddit, or similar public platforms
  • DO NOT bid on VortexHaus brand terms through any online advertising platform
  • DO NOT promote your affiliate link on VortexHaus's official social media profiles or other affiliates' posts
  • DO NOT make false, misleading, or exaggerated claims about the product
  • DO NOT use inappropriate language, hate speech, or reference controversial topics when promoting VortexHaus
  • DO NOT disparage VortexHaus, its products, employees, or business practices in any way
  • DO NOT contact VortexHaus employees on their personal social media accounts
  • DO NOT disclose confidential Program information, commission rates, or internal communications to third parties

VIOLATION OF ANY OF THE ABOVE WILL RESULT IN IMMEDIATE TERMINATION AND FORFEITURE OF ALL UNPAID COMMISSIONS.

G. Confidentiality

During your participation in the Program, and at all times thereafter, you agree to keep confidential and not disclose any proprietary information belonging to VortexHaus, including but not limited to marketing strategies, commission structures, product development plans, and internal Program operations.

H. Representations and Warranties

You represent and warrant that:

  • You are 18 years of age or older
  • You have the legal right to enter into this Agreement
  • Your participation will not violate any applicable laws or third-party agreements
  • You will not infringe on the intellectual property or privacy rights of any third party
  • Your content will not be abusive, harassing, defamatory, pornographic, obscene, hateful, or otherwise objectionable

I. Termination

VortexHaus may terminate your participation in the Program at any time, for any reason, with or without notice. Upon termination, VortexHaus will provide a final commission report and pay any legitimately earned commissions in accordance with its payment policies. Commissions forfeited due to violations of these Terms will not be paid.

You may withdraw from the Program at any time by contacting partners@vortexhaus.com.

J. Non-Disparagement

You agree not to publicly or privately criticize, disparage, or make negative statements about VortexHaus, its products, employees, or business practices at any time during or after your participation in the Program.

K. Independent Contractor

You are an independent contractor, not an employee, partner, or agent of VortexHaus. You are solely responsible for all taxes arising from your participation in the Program. You are not entitled to any company benefits.

L. Modifications

VortexHaus reserves the right to modify these Terms at any time, with or without prior notice. Your continued participation following any modification constitutes acceptance of the updated Terms.

M. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.

N. Entire Agreement

These Terms constitute the complete and final agreement between you and VortexHaus regarding the Program and supersede all prior discussions or agreements.

By applying to the Program, you confirm that you have read, understood, and agree to be bound by these Terms.
